These Terms of Use govern your access to and use of jimarnoff.com and any services offered through this site. In these Terms, “I” and “me” refer to Jim Arnoff, a sole-practitioner career, business, and life coach based in New York, New York. “You” refers to you, the person using the site.

By using this site, you agree to these Terms. If you do not agree, please do not use the site.

What this website is for

This website introduces my coaching practice, my workshops, and my talent-agent consulting. You can learn about my background, watch videos, read frequently asked questions, and request a complimentary consultation through the contact form.

What coaching is not

My coaching is not a substitute for any of the following:

• Mental-health therapy, counseling, or psychiatric care. If you need mental-health support, please contact a licensed clinician. In an emergency, call 911 (U.S.) or your local emergency number.
• Legal advice. Although I am a member of the New York State Bar, nothing on this site creates an attorney-client relationship, and no content on this site is legal advice.
• Medical advice, diagnosis, or treatment. Consult a licensed medical professional for health matters.
• Financial, tax, or investment advice.

Coaching relies on the partnership between coach and client. I do not promise or guarantee any specific outcome, income, career, relationship, or life result. Your results depend on many factors, most of them within your control.

Eligibility

You must be at least sixteen years old to use this website and at least eighteen years old to enter into a coaching or consulting engagement with me.

Acceptable use

You agree not to:

• Use the site in a way that violates any law or regulation.
• Scrape, crawl, or harvest content, or use automated means to access the site without my written permission.
• Attempt to probe, scan, or test the vulnerability of the site, or breach any security or authentication measures.
• Upload or submit content that is unlawful, defamatory, harassing, threatening, obscene, or infringing.
• Reverse engineer, decompile, or otherwise attempt to derive the source code of the site.
• Impersonate any person or misrepresent your affiliation with any person or entity.

Intellectual property

All content on this site, including text, photography, videos, logos, and design, is owned by me or my licensors and is protected by copyright, trademark, and other laws. You may view and share the content for personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from any content without my prior written permission.

Your submissions

When you send me information through the contact form, you grant me permission to use that information to respond to you, schedule a consultation, and follow up about coaching, workshops, or consulting. I will not use your name, likeness, or identifying details in marketing without your permission.

Third-party services

The site embeds videos from Vimeo and may link to other third-party sites. I do not control those services, and I am not responsible for their content, privacy practices, or terms. Your use of those services is governed by their own terms and privacy policies.

Disclaimer of warranties

The site and all content, services, and information are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. I do not warrant that the site will be uninterrupted, secure, or free of errors.

Limitation of liability

To the fullest extent permitted by law, I will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or related to your use of the site. My total liability for any claim relating to the site will not exceed one hundred U.S. dollars (USD $100).

Coaching and consulting engagements are governed by the separate written agreement we enter into for that engagement, and that agreement controls the scope, fees, and remedies for the engagement.

Indemnification

You agree to defend, indemnify, and hold me harmless from any claim, liability, cost, or expense (including reasonable attorneys’ fees) arising out of your use of the site, your breach of these Terms, or your violation of any law or the rights of a third party.

Governing law and venue

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

I may update these Terms from time to time. If I do, I will change the “Last updated” date at the top. Your continued use of the site after the change means you accept the updated Terms.
